Real example — Diego, Tracy. Diego entered EWI at age 14 and turned 18 in 2008. He never registered with Selective Service because no one ever told him he needed to. By 2024 he was an LPR (through his USC wife) and ready to file N-400 — at age 34, well past the 26-year cutoff. We drafted a 3-page sworn declaration documenting his lack of knowledge (no high school in the U.S., no SSA notice, no DMV prompt — he was undocumented), attached supporting affidavits from his mother and high school counselor, and submitted with the N-400. USCIS approved without follow-up RFE. Naturalized in 11 months.
Horror story — same county, wrong answer. A 2022 applicant honestly answered "yes, I knew but I refused" on the N-400 because his church taught him military registration was sinful. The interviewing officer documented the answer in the AOS record. N-400 denied. Worse, the knowing and willful refusal finding is now in his A-file forever — every future renewal, every future immigration interaction, will see it.
Why an attorney is essential: Pre-interview prep on Selective Service is mandatory. The right framing of an honest answer cures the bar; the wrong framing creates a permanent record problem.
