The U.S. Supreme Court reaffirmed in Muñoz that consular visa denials are largely unreviewable in court — even when a U.S. citizen spouse is affected. If a consular officer reads a tattoo as evidence of gang affiliation under 9 FAM 302.5 and denies the visa, you generally cannot appeal that denial to a judge.
